Email to MY Tennessee State Legislative Officials - ASKING for Tennessee to PASS a Bill that ONLY Recognizes the Constitution as the Law of the Land!



UPDATE 12/26/11 - Post about the Comment left on December 25th 2011 at 6:30 PM below - We have the power to make a difference and information of what that bill is, that is mentioned in the comment.


UPDATE As of December 7, 2011 - Not one Tennessee Elected Official has gotten back to me about my email.   So it seems they too don't care about our Constitution nor the Citizens of Tennessee having their rights taken away by the Federal Government.  This is so sad in that We the People don't have any elected official that is willing to actually stand up for the Country and our Constitution!  This is what the State of the Union is now like - the U.S. and State Citizens have been abandoned by their elected officials and what our Forefathers had created in the form of a "More perfect Union."

(If someone writes something better to send to their "State" officials, please send it to me and I will put it on the blog)  I wrote this trying to show how the States can take action on their own and protect their State Citizens against Unconstitutional Federal Laws. 

HERE IS THE EMAIL:
Due to the unconstitutional executive orders and the unconstitutional McCain/Levin bill in the Defense Authorization Act that just passed the Senate on December 1, 2011.


I am asking for a Bill to Recognize the Constitution of the United States as THE LAW of the State of Tennessee.


I am asking the Tennessee State Elected Officials on the State Level to Pass a Law that keeps the Constitution of the United States in Affect IN FULL!  I am asking that a State Law be enacted that says ANY Federal Law or Executive Order that is directly against the Constitution of the United States for the Legal Citizens of the United States is not recognized nor is a law in the State of Tennessee!


Here are the reasons why I am asking for the Tennessee Legislative branch to take these steps to protect the U.S. citizens of Tennessee.


The McCain Levin bill authorizes the U.S. Military to police the streets of the United States and do renditions of U.S. Citizens and they can be held without rights, trials, charges or a lawyer on suspicion of being a "terrorist" against the United States.


I am asking that the state NOT Allow the military nor the Federal government to be allowed to take any U.S. Citizen in the State of Tennessee and will not recognize the McCain Levin Bill, due to it being directly against the Constitution of the United States and the State of Tennessee.


The description in the bill passed by the U.S. Senate is exactly as follows:

b) Covered Persons- A covered person under this section is any person as follows:

(1) A person who planned, authorized, committed, or aided the terrorist attacks that occurred on September 11, 2001, or harbored those responsible for those attacks.

(2) A person who was a part of or substantially supported al-Qaeda, the Taliban, or associated forces that are engaged in hostilities against the United States or its coalition partners, including any person who has committed a belligerent act or has directly supported such hostilities in aid of such enemy forces.

SEC. 5. DETENTION WITHOUT TRIAL OF UNPRIVILEGED ENEMY BELLIGERENTS.
An individual, including a citizen of the United States, determined to be an unprivileged enemy belligerent under section 3(c)(2) ... may be detained without criminal charges and without trial for the duration of hostilities against the United States or its coalition partners in which the individual has engaged, or which the individual has purposely and materially supported, consistent with the law of war and any authorization for the use of military force provided by Congress pertaining to such hostilities.

As you can see the U.S. Senate directly passed a bill that is completely Unconstitutional! 


Here are the United States Bill of Rights:



Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.


A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.[52]


No Soldier shall, in time of peace be quartered in any house, without the consent of the Owner, nor in time of war, but in a manner to be prescribed by law.


The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.


No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.


In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence.


In suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise re-examined in any court of the United States, than according to the rules of the common law.


Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.

  • Ninth Amendment – Protection of rights not specifically enumerated in the Constitution.

The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.


The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

Here is where State LAW OVERRULES Federal Law when the Federal Law is directly against the Consitution of the United States!


Article VI, Clause 2 of the United States Constitution, known as the Supremacy Clause, establishes the U.S. Constitution, U.S. Treaties, and Federal Statutes as "the supreme law of the land." The text decrees these to be the highest form of law in the U.S. legal system, and mandates that all state judges must follow federal law when a conflict arises between federal law and either the state constitution or state law of any state. (Note that the word "shall" is used, which makes it a necessity, a compulsion.) However, the Supremacy Clause only applies if the federal government is acting in pursuit of its constitutionally authorized powers, as noted by the phrase "in pursuance thereof" in the actual text of the Supremacy Clause itself.
The "supremacy clause" is the most important guarantor of national union. It assures that the Constitution and federal laws and treaties take precedence over state law and binds all judges to adhere to that principle in their courts. - United States Senate[1]


This Constitution, and the Laws of the United States which shall be made in pursuance thereof; and all treaties made, or which shall be made, under the authority of the United States, shall be the supreme law of the land; and the judges in every state shall be bound thereby, anything in the constitution or laws of any state to the contrary notwithstanding.

Please stand by the Constitution and stop the Federal Government from taking away the rights of the Citizens in the State of Tennessee.

Does it hurt to send an email to your State Level Elected Officials?  NO!  They have to answer to the people much more than the Federal Elected Officials!   


I am asking everyone to take steps, as this country is "We the People's" Country!  It is not the hand full of people in Washington D.C. committing Treason against us all, Country.  It is OUR Country - They are suppose to Work for US!  They have not worked for us, so now we have to take the steps of trying to help rein in the Federal Government over stepping their bounds and turn the laws back to the States on an Individual Basis!  I believe many States WILL take the correct steps for the Federal government no longer abiding by the Constitution of this Country.   The States know the Federal Government is over stepping it's rights - The State laws are Superior to the Federal Laws, when the Federal Laws are Unconstitutional!  Please join me in emailing your State Level elected officials and lets start a movement!

  1. Each state already has its own constitution and various other laws. Therefore, they don't need to declare the US Constitution, which applies to the federal government, as binding at the state level. Even if they did so, it would have no practical application, other than to make it clear that they are, in fact, part of the union of states which adheres to said constitution. They are free to adopt whatever kind of constitution they want, amending it as they see fit, but obviously the powers enumerated therein will apply to things done at the state level, not at the federal level. Having a state adopt, on some kind of practical level, a document written for the federal level makes no sense, IMO. Adopting something similar yet modified might make some sense, but I believe most if not all did so ages ago. The problem is that the rule of law itself is being annihilated at all levels, and this is being done by those who are duty-bound to uphold it. Indeed, such things have been going at least since the so-called Reconstruction after the Civil War. The fox is guarding the hen house...guess what's for dinner! God bless and keep you, Ma'am.

  2. FWIW, the very thing that will keep many silent until it is too late will also keep the states acquiescent: They are heavily dependent upon federal "money" to function on a day-to-day basis. Their dependence upon the teat is orders of magnitude greater than that of the many people on welfare, etc. It takes a rare man, indeed, to spurn the means of his sustenance in order to do what is right. The War of Northern (i.e. Federal) Aggression, otherwise known as the Civil War, has raged on in political arenas for over a century. It is just entering a new, more odious and onerous phase. Again, not to be a downer, but justice will not be forthcoming via the system. It is, arguably, much too late for that. It will come, but not in the way normal, law-abiding men desire or in the way that most expect. Godspeed to you and yours.

    You people are allowing an out of control 'federal' agency to set up random 'security checkpoints' to harass and search citizens who are merely exercising their right to travel. I won't even address the military ('national guard') participation.
    I can't help but wonder if you are so deluded that you think there really is some terrorist threat that justifies shredding our Bill of Rights that previous generations have sacrificed to protect. Sorry, I guess you have never read it (or history). Maybe you are merely just scared to stand up to the 'feds.' Or maybe you are closet Nazis and really enjoy having your minions order people around. I can't think of any other reasons but I'm sure hearing them will be entertaining.

    I appreciate you having Herr Gibbons respond to my concerns. While I greatly welcome the communication from Oberfuhrer Gibbons I am most desirous of clarification from you, the elected head of my political subdivision. You see I am confused as to how exactly serious is the terrorist threat. I have neighbors who talk with a strange accent, profess to be from another political subdivision of the Homeland, and I have known them for less than 20 years. Could they possibly be a threat? Should I report them to the Homeland Secretariat headed my Ms Napolitano? Possibly you could have an underling respond further?

  5. Anon - When I first read your comment, I was thinking you were giving me an example of the type of letter I would receive back.

    But now I see, you actually sent that letter about the check points they have set up in Tennessee.

    That is a normal response from any govt. official, I understand that.

    That is why I sent the email to EVERY government official in Tennessee.

    Use the email addresses above and email them about all the check points - and bill of rights!

    The more who email their state officials the less they are going to be able to ignore the people! They DO live in the State full time. They have to see the people full time, contrary to the D.C. Gangsters.

    I will want you to write some responses for me, when I start getting my emails back from the state officials! :)

  6. Oh yeah Anon - Haslam was our Mayor here in Knoxville before he became governor. But I really can't think of anything he did that was "For the People". But I always have stayed out of the local politics.
