I started a lawsuit against Litton Loan/Goldman Sachs - MERS - Fremont Bank - Deutsche Bank and Trustee

UPDATED 2013 - THE LAWSUIT NEVER WENT CLASS ACTION.  BUT IT WAS AN INDIVIDUAL LAWSUIT AND I HAD TO SIGN A NONDISCLOSURE AGREEMENT WHEN I SETTLED IT.    I ENCOURAGE EVERYONE TO FILE A SUIT AGAINST THEIR BANK FOR FRAUD!  FIND LEGAL AID AND EVEN UNIVERSITY LAW DEPARTMENTS AND ASK FOR HELP IF YOU DO NOT HAVE THE FUNDS TO FILE A SUIT WITH A NORMAL ATTORNEY!  STAND UP AND DO NOT BE FORECLOSED ON!  IF YOU HAVE BEEN FORECLOSED ON ALREADY, FILE A WRONGFUL, FRAUD FORECLOSURE SUIT AGAINST THE BANK! 

UPDATE 3/2/11 - It seems the Lawyers are not starting a Class Action suit against MERS - I am also rethinking the Lawyers I had hired.  I will give more information as it comes.

I am going ahead and revealing, I have started a lawsuit against Litton Loan, which is a Goldman Sachs loan servicer company, MERS, Fremont Bank, Deutsche Bank and their Trustee.

Right now it is an individual suit but I am working with Class Action Attorneys with the purpose to roll this into a Class Action suit!

There are still many hurdles before then, including a court date this coming week.

Why did I do this?  Because I have asked others to stand up to the foreclosure fraud and originally when I began my mission of trying to get the MERS foreclosure fraud uncovered and class action suits, about one and half years ago, I had planned on being a "behind the scenes person".

All the hours I spent on it, trying to get Class Action Law firms involved before MERS fraud became well known in the media, did not get me any where.   EXCEPT there is one law firm, who I look upon as Heroes!  That is Hager and Hearne in Nevada.  Treva Hearne has worked on getting a class action suit going through out the U.S. in non-judicial suits since Oct. of 2009.  We collaborated for a period of time, until there were various walls put up and the attempts were abandoned.  During the time I was trying to help with a U.S. wide class action, people who I had found in Missouri to be the representatives did get their house free and clear from my understanding from Treva.   Treva is a real hero, she has gone on to do class actions against MERS in California and Nevada for the states and MERS getting away with billions of transfer fees to the states due to their fraud.  From her case other suits have been filed in 14 states.  Most of those suits are gag ordered from the judges of those states.  The judges do not want the information out about the class actions.  The law firms involved can not even acknowledge their involvement in the suits or even confirm there is a class action against MERS.

One firm who can not confirm any involvement in an class action suit against MERS, happens to be the law firm I am involved with at this time.

Also another huge class action law firm, which I collaborated with, from my understanding will be putting class action suits together in all the non-judicial foreclosure states for all homeowners who have already been foreclosed on.

I am going ahead and putting this information out to the public, even though there are a few stages which need to be accomplished before I can say any thing concrete will happen.  First a judge has to approve my suit this coming week. A big problem is no judge in the state of Tennessee has ruled against MERS and banks yet.

I also am admitting this, as this will be part of the topic of conversation during my radio interview with Dave Hodges on the Commonsense Radio show on Sunday, Jan. 9th 2011 at 10:30pm est.   Just click the listen live on the right at the time of the show, if you so desire to listen in.

BUT, a point of this is WE CAN ALL DO THIS TOGETHER!  I AM ASKING OTHERS TO STAND WITH ME AND ALL THOSE INVOLVED IN EXPOSING THE BANKS HAVE NO RIGHT TO FORECLOSE ON ANYONE AND ALL FORECLOSURES THEY HAVE DONE AND DO ARE BASED ON FRAUD!

I am asking people to start contacting me who have been foreclosed on already to get them to join upcoming class actions suits and those who have Litton Loan at this time and Bank of America who are in Tennessee, to become part of a class action against them.  Taking steps of standing up can be very scary if we let those emotions rule us.  BUT if we let the emotions of Truth and Justice rule us, we will feel excitement!

Part of the excitement is the Judges who have stood up for justice and truth, including the Supreme Court of Massachusetts, yesterday.  The highest court there ruled for the homeowners and against the banks right to foreclose.

I am thrilled MSM has written about the foreclosure fraud, though they spin it to be simple "paperwork irregularities".   It still has gotten awareness from people on a whole, of which previously many were not familiar with.

I ASK FOR EVERYONE TO STAND UP!  PLEASE RECOGNIZE YOUR OWN POWER OF TRUTH AND TOGETHER WE HAVE MORE POWER THAN ANY OTHER FORCE OUT THERE!  BELIEVE IN YOURSELF AND OTHERS, BE GUIDED BY TRUTH AND LOVE AND WE WILL BE SET FREE!

PLEASE JOIN ME AND COUNTLESS OF OTHERS WHOSE INTENTIONS HAVE BEEN/ARE TO EXPOSE THE FORECLOSURE FRAUD TO THE FULLEST POSSIBLE!

I will also say - EVERYONE needs to send the letter in this post out to your mortgage servicer via certified mail - it is important to do so.  It shows a trail of you asking for who the owner of your mortgage is, without getting an answer.

  3. Our home is being foreclosed due to Litton's refusal to work with us on loan modification. They claimed they didn't have to participate in the HAMP program when I asked about it. They stalled us making things worse. They couldn't find documents we sent. They sent us back and forth between different departments. Now we are waiting for final foreclosure papers. If you are seriously filing a class action suit against Litton, I want more information.

    1. I also went thru this Hell with Litton and want a class action lawsuit. Everytime I sent in the paperwork, they claimed I had not sent it all in. I even went thru the documents one by one on the phone with their rep and he said he did not know what was going on but he still had to tell me he had not received all of the documents. We had to short sell our home.

    2. I have short sold my home after working with Litton for over 2 years. I have jumped thru every hoop they have asked and still could not get a loan modification. I turned in every paper they requested and every time they would say I did not turn in all of the papers. I have all of my files and have went over page by page with thier rep and he could not understand why they were saying all paperwork not turned in. I am very angry and upset we lost our home.   5. I'm currently battling with Litton. They set a forclosure date of 2/12. I have an offer on the table to them above asking and they've given us three weeks to close. Unreasonable. They want a cash offer with no explanation as to why. I plan on contacting our local TV station to investigate. They refused to postpone the sale date of my home. Initialy I believed I had PMI and it was worth it for them to allow my home to go into foreclosure and collect on the insureance policy. Once the home is sold at the foreclosure date, they get to double dip and get the proceeds from that as well. I discovered I do not have PMI so I'm completely at a loss as to why they are not excepting our buyers solid offer. They excepted it originaly, however, when in got to the final person we were given unattainable dates to close. I will contact you via e-mail.

  9. Litton loan needs to be accountable,Is my mortgage moified by MERS in 2008 and serviced by litton loan still enforceable. I have been trying to modify since July of 2010 with litton to make my home more affordable however it has been an exercise in futility and I now believe since the assumed our mortgage in 2004 the have overcharged and missaplied our funds paid to them rgreish@verizon.net

  10. Force-placed insurances, holding payments past the grace period, misappropriation of our payments, you name it, they did to my husband and I. With our credit ruined, they took our house. With no place to go, we were forced to rent a house from a friend. To add insult to injury, the house is right across from the home lost.

  12. I am interested in a lawsuit if it still possible in 2008 they foreclosed on me and sold property without my knowledge. I stopped the transfer of sale went infront of a judge with a grap lawyer and they allowed the sale to continue. Litton had sent someone out to work with me modification and I was speaking to the person up until the day I received a knock on the door that my house was sold and I had to leave. Apparantely, they had sent me a document with over 200 pages and within the 200 pages the attorney I hired found this letter. I felt betrayed lied to but nothing could be done. I even have the name of the person that was working with me in the modification. what do you think do i have a chance to bring a law suit against them.

  13. I am also interested in joining this suit. They purchased my mortgage in 2007 and added $12,000 on to the original loan though it was never that high. To make a long story short, I then had a cash buyer who waited 6 months and they would not give me a payoff amount. The buyer was furious at me, though my attorneys, the realtor and myself all emailed, left phone messages, and wrote letters and faxes requesting the document. I ended up losing the house. Is this suit still going on? How can we join.

  14. I live in TN and have a Countrywide/BOA predatory mortgage. I have searched for local law firms that are knowledgeable about the fraudulent lending practices that took place with Countrywide, MERS, robo-signing documents etc..I can't seem to find anyone locally that can help..for a reasonable price. Since everyone's loans are different, with different results I wonder if it would not be better for everyone as individuals to get involved in a mass-joinder lawsuit, verses a class action.

  18. yes, class actions will fill the pockets of the attorney's only. If you're still in the process of suing, do it with several other Litton casualties.

    We too lost our home to litton, after following their instruction to a "T," however, they just wouldn't budge on one single issue. Not one.

    Instead, the money that should have gone to our Mortgage, went to attorney fees, to keep our home. They are truly, in every sense of the word, predators.

    Sadly, Goldman and the likes of Litton, will go on under the new ownership Ocwen.

    These are, and will remain, "Those to big to fail." Especially under this leadership..which btw, is no better than the last, (in this arena anyway.)

  19. I went through the same process with Litton's loan modification. Lost documents etc. I gave up after 18 months and am currently in the process of refinancing my home with Wells Fargo. We were supposed to close on the 9th but now I have to deal with OCWEN. They offered to send me a loan modification application!!!!! They have yet to provide me with the payoff statement so I can get away from them. Already have a late fee and don't know where my money has gone over the years.

  20. we lost our home in 2009 to Litton. Same story as everyone else, Litton jacked our payments up saying our escrow wasn't 'padded' enough. we got behind and they wouldn't work with us, then we tried to get refinanced through one of the government help programs. got approved, then Litton didn't accept it and took our home. They sold it last year and we're out thousands of dollars and are back to renting

  22. I have had the same issues with Litton Loan also and since they bought my mortgage from another mortgage..I have had the worst experience with them. I tried for HAMP also and they had me to send in papework over and over until finally they said I had pasted the deadline and I would have to reapply. I did and they stalled and I sent them requested info that they claimed they didn't receive to finally tell me I was disqualified and with my income and income only, that should not have been true..I hate this mortgage company and they constantly adding late fees..I am all for the class action suit against them..

  23. Our experience was the same as everything listed above. In fact, our last provisional loan modification offer was $40 less than our payment! Go figure! And now, they "sold" our note to OCWEN, so we have to start the process all over again. It's all just too futile an effort.

  28. Hello, I am a victim of Litton Loans as well. I started off with Freemont and had an assumable loan, then my loan was then transfered to Litton. I had a hardship and tried to request a modification or deferment, Litton gave me the run around and had me jump through hoops only to tell me no. Then I hired a realtor to place my home up for short sale, Litton again gave me the run around on that one too. An investor contacted me and had me take a look at my closing docs. The closing docs originally signed with Freemont advised that I had an assumable loan, when I contacted Litton they advised that this was unheard of, assumable loans did not exsist and they were unwilling to help at all. Unfortunately my house went in foreclosure and it was put up for auction in April of 2007. I still have this on my credit report and still have all of my closing docs and any correspondance recieved from Freemont and Litton. This was my 1st home, I really didnt know what to do and each time I called Litton they were either rude, sarcastic or just plain unwilling to help me out at all. I contacted them and I was told that everything was okay, not to worry, and that my paper work was sitting on the managers desk.   30. Our experience with Litton is much like everybody else. In our case, Litton began forclosure and we were given a forclosure date. We moved out of our house immediately and now the house has been vacant and unmaintained for almost 2 years without any forclosure action. We did receive a check for escrow reimbersment however we paid our own taxes and insurance. What was in escrow???

    We're getting papers from Ocwen about reworking the loan (they are useless). We don't want the house back as it is in a very poor and unmaintained condition. I'd like to be added to your list. stagemd@msn.com

  31. I am sorry to just be seeing this. Litton loan has lied and defrauded me. my case is much like some of these others. I lived in my home over 30 years and now have lost it. they told me right out lies. They would not return my calls and led me to believe they were going to modifie my loan for a year and a half. They even had a rep came to my home to offer the modification. Then sold my home with out notice, behind my back. Since the foreclosure I have been to court several times because they lied and said they gave service for eviction that was never given I went to court and proved it. But only to delay the process. I have been lied to over and over again. I tried to get a lawyer but no one wants to touch the banks. I would like more information on any progress you have had and would be interested in any action you have against these unscrupulous companies. We need justice to protect the regular people. I too was a victim of litton loans, they sold my loan in Nov 2011 to Ocwen, who sent me introduction letter welcoming me to their company, and the transfer balance litton reported to ocwen was several thousands of dollars more than what i borrowed, they said there was suspence transfer fees etc...i told them i didnt ask for my loan to be sold, so why should i incur all these transfer lender fees...not my problem... now i own several thousands of dollars MORE than what my orignial balance was with them.... Also my late fees were never $25 for being late, which is what was stated in my loan papers, that if i am late then i am to pay $25 fee, well i asked Ocwen the new lender for a print out of my history, from litton loan, it shows litton charged me $1,200 late fee one month, then $500 the next, so i called ocwen to them asking what happenend to the $25 flat late fee im supose to have, they said litton is no longer in business and ocwen bought all their accounts (after reaseach online Ocwen is owned by Litton Loan - go figure!) and they can't give me an answer to my question because they don't have the archived files or any orignial loan docs for litton. So i need to get an attorney but dont have the money to pay them to investgate my loan...something isnt right..... so i feel they have scamed me out of late fees.... !   35. I am too a victim of Litton Loan, I always paid my mortgage payment on time and was in my home for 9yrs. The economy went bad and when it was time to refinance to an adjustable my home value wasn't worth my loan. I tried to work with Litton and they refused, I lost my home, I would like to be included in this suit.

  37. Just found out I am not in the "data base" for the Independant Forclosure Review. Litton did a "Subsitution of Trustee" to HSBC Bank.
    HSBC is one of the servicers being reviewed. HSBC never directly serviced my loan so I'm left out to dry once again. I am all for a class action suit against Litton. Where do I sign? Claudia Dysard

  38. Someone at Ocwen bought my mortgage from Litton at an extreme discounted rate, probably 2-3% of what I owe. It would certainly be great if I could somehow do the same.

    Ocwen didn't really buy anything, this fraudulent MERS, et.al. scheme has already been uncovered through congressional investigation and no one went to jail and the only thing that happened was Ocwen and the rest paid billions to our government to continue looking the other way.

    In case anyone hasn't been paying attention lately, the housing markets and predatory lending is shaping back up like it was 2005 all over again. The no money-down loans are already back in full swing.

  40. My loan was sent to Litton in September 2010. I got one letter, no documents as to where to pay or nothing for 14 months. I tried to call them at least 50 times and my loan number was not in their system. Then in 2011, I get a 1099-C. They sent it in February a month late. Then they sold my loan to OCWEN, Ocwen did the same thing and sent me a 1099-C last week. Both Litton and Ocwen is reporting the same loan twice on my credit report and both companies have different loan numbers and did split the one loan and made two different loans. My credit report show 2 different loans and they doubled my loan total balance which increased my debt and also increased my bad credit times 2 so I can't not refinance. I writing the IRS and the RESPA ("TILA") and complaining about them. Then I going to take a road trip to West Palm Beach an study where these people are at that are doing this and document their activity and video them and put it on YOU TUBE for the world to see where they live and what they are doing.

  41. I had NO knowledge of the suit until March 2015. These crooks never attempted to contact me nor make any attempt to send the class action lawsuit forms. Once I started searching to obtain more information about it I discovered I was not the only person they intentionally did not send the paper work to. A New Lawsuit against them needs to be filed by those who who did not get JUSTICE. THE ATTORNEY GENERAL SHOULD FILE AN AMENDED COMPLAINT AGAINST THEM. I can produce paper work which shows the paperwork they falsified. I took the paper out of the trash can. They were dumb enough not to shed it.
